Please read this document carefully. It contains important information about your rights and obligations, as well as limitations and exclusions that may apply to you.
This Agreement contains the terms and conditions that apply to purchases by customers from The Swim Advantage for swim equipment, accessories, apparel, and related products sold in the United States. By placing an order or accepting delivery of products purchased from The Swim Advantage, the customer agrees to be bound by these terms and conditions.
If for any reason you are not satisfied with your purchase, you may return eligible products under the terms of The Swim Advantage return policy.
These terms and conditions are subject to change without prior notice at any time, at The Swim Advantage’s sole discretion.
This Agreement and any sales under this Agreement shall be governed by the laws of the State of Illinois, without regard to conflict of law rules.
Payment terms are within The Swim Advantage’s sole discretion. Unless otherwise agreed to by The Swim Advantage, payment must be received before an order is accepted or fulfilled.
Payment may be made by credit card or another approved payment method. Orders are not binding upon The Swim Advantage until accepted. Any quotes provided by The Swim Advantage are valid only for the period stated on the quote.
Separate charges for shipping, if applicable, will be shown during checkout or on the invoice.
The customer is responsible for sales tax and any other applicable taxes associated with the order unless a valid tax exemption certificate is provided before the order is accepted.
Title to products passes from The Swim Advantage to the customer upon shipment or delivery, depending on the fulfillment method. Risk of loss or damage during shipping may depend on the carrier and shipping method used.
Product warranties, if any, are provided by the original manufacturer. The Swim Advantage does not make additional express warranties beyond those provided by the manufacturer.
Warranty coverage, service, and support may vary by product and manufacturer.
Eligible products may be returned for a refund of the product purchase price, excluding any shipping charges, if returned unused, in new condition, and with all original packaging and materials within 14 days of purchase.
Products that have been used, worn, damaged, altered, or returned without original packaging may not be eligible for return.
The Swim Advantage may allow exchanges in its discretion. Eligible products must be exchanged within 14 days of purchase and must be unused, in new condition, and returned with all original packaging and materials.
Customers are responsible for checking packages for accuracy and condition upon receipt.
Any shortage, incorrect item, or shipping damage should be reported to The Swim Advantage within 48 hours of receipt so the issue can be reviewed.
The Swim Advantage may update, revise, or discontinue products at any time. If an ordered product is unavailable, The Swim Advantage may contact the customer before making any substitution or adjustment to the order.
The Swim Advantage acts as a retailer. Warranty and technical support for third-party products are provided by the original manufacturer, not The Swim Advantage, unless otherwise stated.
The Swim Advantage does not accept liability beyond the remedies set forth in these terms.
The Swim Advantage will not be liable for consequential, special, indirect, incidental, or punitive damages, even if advised of the possibility of such damages.
Customer agrees that any liability related to the purchase of products shall not exceed the total amount paid by the customer for the product giving rise to the claim.
Swim equipment and related products should be used only as intended and with appropriate supervision, instruction, and care.
The Swim Advantage is not responsible for injury, misuse, improper fit, improper use, or failure to follow product instructions or safety guidance.
Any claim, dispute, or controversy arising from or relating to this Agreement, its interpretation, or any purchase from The Swim Advantage shall be resolved exclusively and finally by binding arbitration, to the fullest extent permitted by applicable law.
The arbitration shall be limited solely to the dispute between the customer and The Swim Advantage. Any award by the arbitrator may be entered as a judgment in any court of competent jurisdiction.
Customer agrees to comply with all applicable laws and regulations. Customer agrees that products are purchased for personal or organizational use and not for resale, unless otherwise agreed in writing by The Swim Advantage.
